Криптовалюту сложно ограничивать законами напрямую. Реальный рычаг контроля находится в AML — у компаний, которые размечают блокчейн. Любой адрес можно одним движением окрасить в красный, и для этого не нужно ни одного судебного решения. Раньше у такой разметки была хоть какая-то логика: бирже приписывали связь с даркнетом, искали следы отмывания, спорили о методике. Сейчас правила игры поменялись. Российским и белорусским криптопроектам ставят прямую метку «EU Russia/Belarus CASP Sanctions». То есть политическое решение Брюсселя превращается в фактический бан без обсуждения. На практике это означает несколько вещей. Для бизнеса вырастают издержки и риски блокировок при работе с внешними площадками. Маршруты вывода средств на крупные международные биржи будут постепенно обрубать: повышать комиссии, ужесточать проверки, закрывать обходные пути. Для обычного пользователя это значит, что даже бытовой перевод денег через крипту за границу становится задачей со звёздочкой. В комплайнсе работает принцип наибольшего риска. Когда западный AML красит адрес, любая крупная иностранная биржа смотрит именно на него, а не на оценку российского сервиса. По моим ощущениям, мы наблюдаем переход санкционной войны на новый уровень. Внешняя инфраструктура для российских криптопроектов сужается. И это, как ни странно, ускоряет то, что и так шло естественным путём: построение собственной архитектуры рынка с российской юрисдикцией, внутренним оборотом и понятными правилами игры. Тем, кто работает внутри российского регулирования, в новой реальности конкурировать за пользователя становится легче. В Decimal мы движемся именно в этой логике.
